Typical fields include your name, email, phone number, and free-text notes about what you're looking for or selling. We never ask for bank details, ID numbers, or payment information through this site.

We also receive technical data automatically (IP address, browser user-agent, pages viewed) to operate the site securely and measure aggregate traffic. This data is not linked to your identity unless you submit a form.

3. Lawful basis for processing

Under Article 6 of the EU General Data Protection Regulation (GDPR), we rely on:

  • Consent — when you submit a form, you consent to us contacting you about the enquiry.
  • Legitimate interests — responding to enquiries, matching buyers with suitable properties, and maintaining secure site operations.
  • Legal obligation — compliance with Spanish anti-money-laundering (Ley 10/2010) and tax reporting requirements, when we progress to an actual transaction.

We do not sell your data. We do not share it with unrelated third parties for marketing purposes.

5. Who we share data with

Your data may be shared with carefully selected processors that help us operate:

  • Email and CRM providers (for storing your enquiry and responding)
  • Cloud hosting and analytics providers (for running this website)
  • Lawyers, notaries, or gestors — only when a transaction is underway and only with your knowledge

All processors are bound by written data-processing agreements and GDPR-equivalent protections. Where data leaves the EU/EEA, we rely on Standard Contractual Clauses.

6. How long we keep your data

We retain personal data only as long as necessary for the purpose it was collected:

8. Security

We apply reasonable technical and organisational measures to protect your data against unauthorised access, loss, or alteration. No system is perfectly secure; if we ever became aware of a personal data breach affecting you, we would notify you and the AEPD as required by law.

9. Email Subscriptions

We operate two opt-in email lists: a public newsletter (buyers and sellers) and an agent network (industry partners). Both are explicit opt-ins — you only receive these emails after submitting a signup form on this site and ticking the consent checkbox.

Lawful basis under GDPR Article 6(1)(a): consent. You give consent by ticking the checkbox at signup, and you can withdraw it at any time via the unsubscribe link in every email or by writing to us.

For each subscription we store:

  • The email address you submitted
  • Optional name and (for agent signups) company, country, phone, and notes
  • The exact consent text you ticked, in the language you saw it
  • The page you signed up from and the date and time you consented
  • Your preferred language for receiving communications
  • A bot-verification token from Cloudflare Turnstile to prevent abuse

Subscription data is stored in our own database (the audit record, hosted in the European Union) and forwarded to Resend, Inc. (United States), our email-delivery processor, who sends the messages on our behalf. Data transfers to the US rely on Standard Contractual Clauses.

Every email we send includes an unsubscribe link — one click removes you from the relevant list. You can also exercise any GDPR right (access, rectification, erasure, portability) by writing to info@marbellaspecials.com.

We retain subscription records until you unsubscribe. We aspire to a periodic engagement review (typically 24 months of inactivity) to prune dormant subscribers, but that review is currently a manual process rather than an automated retention policy — we mention this in the spirit of honest disclosure.
